Bo and Yisro. Rabbeinu Bachya (Bachai) on Rei'echa.

We are not discussing the meaning of רעהו or  רעך or  רעותה. There are innumerable proofs back and forth on that topic, and I have m'ms at the end of the post. I am only addressing one thing: the stira in Rabbeinu Bachay.

There seems to be a blatant contradiction in Rabbeinu Bachay as to the meaning of the word Rei'acha/Rei'ei'hu.  

In Bo, Shemos 11:2 he says that only before mattan Torah were Gentiles called Rei'ei'hu to the Jewish people.  But this changed with mattan Torah, after which the Torah only speaks to Jews of their fellow Jews as Rei'ei'hu.

וישאלו איש מאת רעהו......  ומה שהזכיר לשון רעהו ורעותה, יראה לי שקודם מתן תורה היו כל הבריות חברים כאחד אבל לאחר מתן תורה שהחזיר הקב"ה את התורה על כל אומה ולשון ולא קבלוה עד שקבלוה ישראל יצאו כל האומות מן האחוה והריעות ונשאר השם הזה בעם ישראל בלבד שנקראו אחים ורעים למקום הוא שכתוב (תהילים קכ״ב:ח׳) למען אחי ורעי, וזהו שדרשו רז"ל (דברים כ״ב:ג׳) לכל אבדת אחיך, אחיך ולא גוי, וכן (שם כג) לא תשיך לאחיך אחיך ולא גוי.

But in Yisro 20:13 he directly contradicts this, by saying that at the Aseres HaDibros, the word Rei'acha means your fellow, Gentile or Jew, and he proves it from Parshas Bo. Just as in Parshas Bo it means Gentiles, so in the Aseres haDibros it also means Gentiles.

לא תענה ברעך. לא אמר באחיך כמשפט הכתובים (דברים כ״ג:כ׳) לא תשיך לאחיך, (שם כב) לכל אבדת אחיך, וכיוצא בזה, כי שם אנו דורשים אחיך ולא עכו"ם וכאן הזהיר אפילו על העכו"ם כי כן מצינו (שמות י״א:ב׳) וישאלו איש מאת רעהו והוא נאמר על המצריים, ועוד שאלו אמר באחיך היה נראה שהעדות כשרה בקרובים כי לא יזהירנו אלא מעדות שקר אבל עדות של אמת כשר ואין הדבר כן כי כל עדות פסולה בקרובים הן שיהיה שקר הן שיהיה אמת הן יהיה לתועלתו או להפסדו. והיה הכתוב ראוי לומר לא תענה ברעך עדות שקר, ואלו אמר כן לא היתה האזהרה כי אם למעיד עצמו שלא יעיד הוא עצמו עדות שקר, אבל כשאמר עד שקר יתבאר מזה שהוא אזהרה שלא יהיה נסכם להזמין עד שקר, וזהו לשון לא תענה לא תסייע ולא תזמין ברעך עד שקר שיעיד עליו.

Additionally, as Rabbi Avraham Bukspan pointed out, his words in Parshas Yisro are k'neged many Gemaros which assume, as he said in Bo, that the word rei'acha/rei'ei'hu denotes a fellow Jew. And, as we pointed out, he contradicts himself.

Rav Chavel points out the contradiction, and quotes someone that shall remain nameless who offers a very, very, very, unconvincing explanation - that, reminiscent of the Kesef Mishneh in AhT 6:15 by tevilla, the distinction between Jew and Gentile only vested at the END of the Aseres HaDibros, not while it was being given. Lord have mercy. That's an example of why waterboarding is not useful - in extremis, people will say anything.

But Rabbeinu Bachay did not make mistakes. So what seems like an irreconcilable contradiction obviously is not a problem, and the answer must be pretty simple, so simple that Rabbeinu Bachay didn't think he needed to explain it.

The answer requires only that we modify one assumption, and that is, our assumption that רעך is the same as רעהו. It is not.

רעהו connotes a רע of the Ribono shel Olam. As Rabbeinu Bachay writes in Bo, רעהו means Hashem's Rei'im,  אחים ורעים למקום. The word רעך, on the other hand, means your fellow. 

 רעהו once meant everyone until Matan Torah, when it changed, as the Gemara in BK 38a says by שור איש את שור רעהו. But רעך means everyone and still means everyone.  Rabbeinu Bachai's proof from ve'yishalu in Bo is just that the word rei'ah/רעה can include a non Jew, as it does there. After mattan Torah, though, when it says rei'eihu, it means only a Jew. But Rei'acha still means your fellow, Jew or Gentile.

I am aware that this raises serious questions about how Rabbeinu Bachay will read the passuk in Vayikra 19:18,  

לא תקם ולא תטר את בני עמך ואהבת לרעך כמוך אני ה' 

first, because it is highly unlikely that there's a din ahava, to say nothing of ahava kamocha, if you're not מצווה להחיותו (and the Toras Kohahim there says that it refers to a ger- I assume a ger toshav-), and also because the beginning of the passuk will then be inconsistent with the end. But that is not my problem. You'll have to figure out how Rabbeinu Bachay in Yisro will deal with it. (Or you could use Rabbi YG Bechhofer's discussion of the Sefer HaBris' chiddush on this question. But it seems to me that the chiddush is a daas yachid, especially in light of the Toras Kohanim.  I am not an advocate of, pardon the Latin, Ignotum per ignotius.

Here is the Sifra/Toras Kohanim on Kedoshim 8:3-4

[ג] "כאזרח" – מה אזרח שקבל עליו את כל דברי התורה אף גר שקבל עליו כל דברי התורה. מיכן אמרו גר שקבל עליו את כל דברי התורה חוץ מדבר אחד – אין מקבלים אותו. ר' יוסי בר' יהודה אומר, אפילו דבר קטן מדקדוקי סופרים.

[ד] "יהיה לכם הגר הגר אתכם ואהבת לו כמוך" – כשם שנאמר לישראל "ואהבת לרעך כמוך" כך נאמר לגרים "ואהבת לו כמוך". . )


postscript: 

The Gemara in BK 38 that I mentioned begins by saying the רעהו excludes Gentiles, just as it excludes הקדש. There is a machlokes whether that is true in the maskana. The Gemara asks, if רעהו excludes עכו"ם, then the din of nizkei shor should not apply whether ours damaged theirs or vice versa. 

ממה נפשך אי רעהו דוקא דכנעני כי נגח דישראל נמי ליפטר ואי רעהו לאו דוקא אפילו דישראל כי נגח דכנעני נחייב 

So the Gemara answers 

א"ר אבהו אמר קרא (חבקוק ג, ו) עמד וימודד ארץ ראה ויתר גוים ראה שבע מצות שקיבלו עליהם בני נח כיון שלא קיימו עמד והתיר ממונן לישראל. דרבי יוחנן אמר מהכא (דברים לג, ב) הופיע מהר פארן מפארן הופיע ממונם לישראל

Some, for example the Maharam, understand this to mean that the Gemara is saying אלא, and has dropped the רעהו למעוטי עכו"ם, and now is saying it's a din in vitur. Others, like the Ran the Maharam brings, hold that רעהו למעוטי is the maskana of the Gemara.  Maharam:

ד"ה עמד והתיר ממונן לישראל משמע דוקא בענין זה שנגח שור שלנו שור שלהם וכו' כך היא הגירסא בספרים שלפנינו משמע דהאי דנגח שור שלנו את שור של כנעני דפטור נמי אתיא מקרא דראה ויתר גוים ולפ"ז צ"ל דמסקנא דמשני רבי אבהו אמר קרא עמד וימודד ארץ וגו' כוונתו לומר דלעולם לענין כנעני רעהו לאו דוקא ר"ל דכנעני לא אימעט מרעהו דיכול להיות דכנעני נמי מקרי רעהו והא דכי נגח שור דישראל את שור של כנעני פטור היינו מטעם דראה ויתר גוים ולכך נמי דשור של כנעני שנגח שור ישראל חייב. נזק שלם ואע"ג דלעיל משמע דלכ"ע רעהו דוקא היינו לענין הקדש דבהקדש לא שייך רעהו והוי כאלו כתיב את שור איש דהקדש לא הוי בכלל וכנעני הוי בכלל אבל בר"ן משמע דגם לפי המסקנא הא דנגח שור שלנו את שור כנעני דפטור אתיא מרעהו דרעהו דוקא אלא דכי נגח שור של כנעני את שור שלנו דמשלם נ"ש הוי מטעם קרא דראה ויתר גוים וזה טעמו של מהר"ש לוריא שכתב בספר ח"ש שגורס בתוס' דוקא בענין זה שנגח שור שלהם את שור שלנו וכו' ע"ש:

Since it is the better part of a century since I was fifteen years old, I will not say that in Bo, Rabbeinu Bachai is saying like the Ran, and in Yisro, he is saying like the Maharam.  Clearly, he is saying like the Ran, that the maskana of the Gemara is that רעהו excludes עכו"ם. But, as I said, he just holds that the miyut is not because they our not OUR רעים.  There might be an entirely different definition as to what comprises our רעים. Maybe it means friends, compatriots, fellows, people who sympathize with you....I do not know. The מיעוט is because they are not רעים of the Ribono shel Olam.  As he says in Bo, עם ישראל בלבד שנקראו אחים ורעים למקום.


I mentioned earlier that I'm not discussing what  רעהו or  רעך or  רעותה mean in Tanach. There are many different shittos and possibilities, including תנא דבי אליהו רבה ט״ו and ב"מ פ"ז and קי"א and the מושב זקנים  on איש לרעהו and the אחיעזר חלק ג ל"ז ה- ו and the 'רמב"ם רוושמ'נ ד and רש"י סנהדרין נז עמוד א and the Gaon's talmid in his ספר הברית which Rabbi Bechhofer discusses here. That is all besides the point. I am only talking about the Rabbeinu Bachay.
