Simanim, Positive and Negative, for Rosh HaShannah

I rarely post here any more. Now I post Torah thoughts at Beis Vaad. But this is so unserious, I could not bring myself to post it there, so here it is.

Siman 583 discusses auspicious and inauspicious foods and behaviors for Rosh Hashanah.  Here are some brief personal comments and suggestions.

1. Nuts. The Rema brings a minhag to not eat nuts on Rosh Hashanna.   My mother made honey cake with walnuts for yomtov.  My wife asked her how she could use walnuts when we don't eat nuts on Rosh Hashanah, and my mother said "Drei mir nisht kein kop." In my mother's lexicon, those words meant that the families of the Talmud Torah in Kelm used to make honey cake with nuts on Rosh Hashanah, so that was the end of the discussion.  (My mother's father, Harav Akiva Berlin, was one of the greatest talmidim of the Kelmer Talmud Torah, and he was Rav Chatzkel Levenstein's chavrusa there. When my mother came to visit him in Eretz Yisroel he stood up for her in honor of her father, or maybe in honor of my uncle, Rav Mottel Pagremanski.)

2. Grapes. Maaseh Rav 204, that the Gaon did not eat grapes on Rosh Hashanah, brought and discussed in the Kaf Hachaim, who brings Brachos 56b and a Zohar that seem to be negative about black grapes, but that the Zohar later seems to be positive about them:

Piskei Tshuvos in 683:7 brings that some source the Gaon's hanhaga to a Zohar involving the Etz HaDaas on Rosh Hashanah.

The Piskei Teshuvos also brings in note 46 from Orchos Rabbeinu that said that in the last year of the Chazon Ish's life he said that the only reason the Gaon refrained was because the only grapes that were available to him were sour.

Here is my personal experience. We were in Reb Moshe's office in Staten Island on Rosh Hashanah and either Rav Pesach Brody or Rav Moshe Meir Weiss, both then bachurim, brought the Rosh Yeshiva some grapes in the afternoon, and he declined.  He asked the Rosh Yeshiva, the Maaseh Rav says the Gaon didn't eat grapes on Rosh Hashanah, are we noheg like that? The Rosh Yeshiva said that he just wasn't interested in eating at that moment. Then he thought about the Gaon's hanhaga, and said that there is no makor in Chazal that would be the basis for such a minhag so there is no reason for us to be careful. The bachur asked, maybe someone had the same experience with the Gaon, that he brought him grapes and he simply did not want them, and he misconstrued it as a hanhaga? The Rosh Yeshiva said no, he does not believe that. The Rebbetzin, having seen many such misunderstandings of the Rosh Yeshiva's behavior, thought that was a good explanation, and already being slightly hard of hearing, repeated that suggestion. The Rosh Yeshiva exhibited some impatience and said that the Siddur HaGra and the Maaseh Rav was carefully examined by talmidim of the Gaon and by the Vilner Beis Din, so it was not stam a misunderstood story. But even so, whatever the Gaon's reason was, he, Reb Moshe, holds there is no reason to avoid grapes le'maaseh.

So both Reb Moshe and the Chazon Ish said there is nothing wrong with eating grapes on Rosh Hashanah.

Also, from the Machzor Vitri, that the minhag in France at the time of the Rishonim was davka to eat grapes, but he specifies white grapes, on Rosh HaShanah.

The Piskei Teshuvos, not my photo, found it online, so I'm לא תגזזו אתון אלא לגזזוה אינהו ויהבו לכו in Sukka 30a.

So don't worry about grapes. Even if you do avoid grapes, don't be like the people that are worried about the raisins in raisin challah, raisins being the subject of the Forum on the topic. My achrayus; you have nothing to worry about.

3.  My mother always made Farfel on Rosh HaShanah, and again, that means they made it in the Talmud Torah families in Kelm. She did not know why. She speculated that it was because it was oily, a siman of ashirus.

4.  Simna Milsa.

The minhag of eating auspicious Simanim is the main topic of OC 684. As you all know, many years ago, a very choshuveh posek in Baltimore was the one that came up with cutting a raisin in half and putting it into a piece of celery, so we should be zocheh to "have a raise in salary." A friend of mine suggested that you pass it out under the table, so you shouldn't have to pay taxes on it.
In that spirit, here are some suggestions to break out of the over-analyzed, over-sanctified, simanim rut. I am confident that they are no less valid than any others. In fact, the Mishna Berura there says that you should use simanim that make sense in the local language, whether it's Hebrew, or Yiddish, or Turkish -

In these new simanim I am not going to do בשם ואמרו. because I think that b'sheim omro only is a maalah when the person you're quoting would be proud to be identified.

I know that much of this is childish, but wouldn't an illustrated version of the new simanim be a pleasant change from the ubiquitous, pious, laminated cards we get every year?
And since color pictures lend credibility, I've added that, too. Feel free to print it out, and laminate it, and surprise your friends and neighbors.

- About apples- note that the Machzor Vitri I quoted above says red apples, but the Rema just says sweet.

Heart of Palm:
based on

Hot peppers:
We should be zocheh to say sharp Pilpul.
based on

Sweet Peppers:
We should be zocheh to say Geshmakkeh, or sweet, Pilpul. I remember my parents telling me that Reb Elchonon said about Reb Mendel Kaplan that he had "a head like a violin," that his lomdus was so sweet.

Beer:
based on

(make sure to pour it carefully so it doesn't have a head, because the foam is called קצף, and you don't want to drink קצף. You also do not want to cut off its head, obviously not a propitious harbinger unless you belong to the Taliban. Add to that the fact that my shver Shlitah, Rav Reuven, follows the Gemara in Chulin 105b where Abaya says דְּלָא שָׁתֵי אוּפְיָא, that the foam on drinks is insalubrious.

Chicken Liver, Leberlach:
We and the people we invested our money with (I wrote this years ago, and unfortunately, it was an unanswered prayer) should be inspired to  לֱעבּ־עֶרלַאך.

(Parev- it's Tofutti) Pizza:

Sausage,

Lettuce,

Shnitzel:

Star Fruit:

Wax Beans dipped in Techina:
(שעווה, שוועה, for simanim it's close enough.)
(Wax beans are a kind of edible string bean with a pale yellow pod instead of green.)

Beans in a Heart of Palm:
Do not use Fava beans. In Aramaic and Arabic they're called "Fool."

Helzel, if you're from Litteh or Russia, and you're lucky enough to get it:
alternatively

Yams:
We should dive deep into the Yam HaTalmud. My father זצוק"ל, who learned with Reb Leizer Platzinsky all his years in Slabodka, learned and knew klor (according to the Rogotchover's assessment) all of shas including the mashechtos ketanos and the introductions of the Tiferes Yisrael to Mishnayos. said that the difference between someone who knows everything and someone who knows just the basics is the difference between splashing in a kiddie pool and swimming in the ocean.

Mayonnaise:
This only works if you pronounce the Cholem like the Feinsteins do - a long ā, like Ribeinei shel Eilem, thus, mayoneis hachochmeh.

Squash:
Our enemies should be squashed.
based on Tur and Mechaber OC 583:1,

Pickles (brine, not vinegar, for those of us
that don't use vinegar till Hoshana Rabba)

Chicken wings, preferably four:

Sardines.

This one is good for at least three simanim - fish, hot pepper, and sar din.

From R Menachem Shafran -
A Sunny Side Up.
May our lives always be sunny side up.
My first impression was that even by the standards of "simanim," it was sort of silly. But after thinking about it, I decided that the Pollyanna-ish and Panglossian incongruity with the extremely stressful, even terrified, mood of "Unesaneh Tokef," make me smile, as Tom Lehrer said.

and, once we're talking about eggs,
Eggs:

Banana for bonne année, Good Year in French. (Banana in French is also banane.)

Since I have descended to the nadir, I want to share one of the inevitable "Siman Questions" rabbanim get around this time of year - which involve the minhag not to eat אגוזים, nuts, on Rosh HaShanah because it's not a good Siman.

This one was "Can I use coconut oil in a Rosh HaShanah dish?"

Looking to the botanic definition is absurd, because anything that develops with a soft exterior is not a nut, which would exclude walnuts, almonds, filberts, and cashews. The botanical and the culinary definitions are almost mutually exclusive, unless you eat beech nuts and acorns. So obviously, we're thinking about the vernacular. On that basis, my answer was

1. Since the flesh firmly adheres to the inside of the shell it is clearly different than what we call a nut.

2. Additionally, the presence of liquid inside distinguishes it from what we commonly call nuts.

3. Even if it is a nut, (which it is not,) perhaps we can be meikil. The extracted oil is a shinui gamur, and what is Rosh HaShanna about, if not being meshaneh Aveiros into Zechuyos? Many don't eat grapes, but I haven't heard about not drinking grape juice.

So, in all humility, and fully cognizant of how significant this issue is, I am comfortable paskening that one may use coconut oil in Rosh HaShanah dishes. It is not a siman of חטא.

HOWEVER, one should be aware of the opinion of Professor Karin Michels, an epidemiologist at Harvard. According to Professor Michels, using coconut oil is a Siman- it is a siman of tipshus.

Aseres Yemei Teshuva and Parshas Vayelech. Sometimes, the Ribono shel Olam taps you on the shoulder.

Around a year ago, my wife and I began learning Tanach together. We have gone through Yehoshua, Shoftim, and Melachim, all with Rashi. My wife was not looking forward to beginning Yeshaya, because the Hebrew is idiomatic, and because it is so depressing. Nonetheless, we began. We found Rashi to be much lengthier than elsewhere, and that added to the challenge, so we cut down our usual twenty or so pesukim a night to five. We discussed changing our way of learning, because the length of Rashi made it so much harder, so maybe we would find another peirush for our seder, maybe the Radak.

Come Friday night, she says that it probably is not appropriate for her to learn Yeshaya on Shabbos, because it makes her teary eyed, as do all the stories of tragedies and missed opportunities. I say that we should try anyway. So we sit down to learn, including Rashi.

Here are the Pesukim we learn Friday night.

Rashi on passuk 16:

".... Wash, purify, remove, cease, learn, seek, uphold, judge, fight, come: ten mandates of repentance here, corresponding to the Ten Days of Repentance [between Rosh Hashana and Yom Kippur] and corresponding to the ten verses of Kingship, Remembrance, and Shofar."

The ten imperatives in Pesukim 16, 17, and 18, correspond to the I never would have known this. How often are the עשרת ימי תשובה referred to in Tanach? So far, only one other place, where Naval died ten days after he insulted Dovid HaMelech, those were the (RH 18a.) To have learned Tanach a whole year, to get to Yeshaya, to wonder whether yes Rashi or no Rashi, to decide to do it anyway, and to do it now, and to learn davka the pesukim that are meramez to the עשרת ימי תשובה, that is not just general information.

Even more: This week is Parshas Vayelech. In 31:18, the Torah warns us that Klal Yisrael will face Hester Panim.

Rashi in Yeshaya 8:17 brings a Yerushalmi (San 10:32) that discusses the "Hester Panim" mentioned in our Parsha. The Yerushalmi says that there was no worse moment of Nevu'ah than that moment when the Ribono shel Olam said through Moshe Rabbeinu that there would be הסתר פנים.

We are used to thinking of הסתר פנים like the story of Megillas Esther, that Hashem hides from us, that His Hashgacha Pratis is hidden behind Teva. But the Navi Yeshayahu tells us that there is an aspect of Hester Panim that is much, much, worse than that. This is the aspect kind of Hester Panim that the Gemara in Chagiga (4b) uses our pesukim in Yeshaya 1:12 to explain.

This is an aspect of Hester Panim where Hashem doesn't want your mitzvos.

The Navi Yeshaya applies this to the Avoda of the Beis HaMikdash - I have no interest in your korbanos. Who asked you to make Aliyah LeRegel? Your Yomtov gatherings make me tired. But the Rambam and Rabbeinu Yonah explain that this הסתר פנים is not limited to the things the Navi Yeshaya described, it is total. All the mitzvos you do are rejected by the Ribono shel Olam. This is not an issue of עבירה מכבה. This is an iron curtain created by failure to do Teshuva.

The Rambam (Teshuva 7:7) says that when a person has not done Teshuva, the RBSO does not want a person's mitzvos. Not just Aliya l'regel - all mitzvos.

Rabbeinu Yona says this in Shaarei Teshuva (א' מ"א) as well.

All the mitzvos, and maasim tovim, and Torah, that you did, Hashem tears them up in front of you; Only after Teshuva they are changed into zechusim.

That means that when a person does not do Teshuva, then his heartfelt davening is not a davening, his mehuderdikkeh tefillin is not tefillin, his hasmada in Torah is not Torah. Only with Teshuva do these things turn to your eternal benefit.

Learning this Friday night of Shabbos Shuva felt like a Navi knocked at my door with a message from the Ribono shel Olam. "The Ribono shel Olam wants you to know this: It is the עשרת ימי תשובה, and you had better take this very, very, seriously."

We don't have neviim, we don't even have a bas kol. But we apparently do have something. That "something" arranged that after almost a year of learning Tanach, during Aseres Yemei Teshuva, the night before we read in Parshas Vayeilech about Hester Panim, we read a Rashi that told me that until a person does Teshuva, all his Mitzvos and Maasim Tovim just make the Ribono shel Olam tired. They bring no Ritzui. The person is in a self imposed condition of Hester Panim, a Hester Panim that means not only that Hashem is hidden from him, but far worse, that Hashem does not want to see him or his pathetic mitzvos and Torah.  In order to escape from that miserable condition, the Navi told us we have Aseres Yemei Teshuva. These Aseres Yemei Teshuva are not just a matter of time passing. They represent the ten steps a person must take to climb out of his pit of Hester Panim. They are

The Gaon in his Peirush on Nach (MHK) says

The notes from R Meir Yehoshua Katzenellenbogen there:

Reb Tzadok Pri Tzadik Devarim 11:

Rabbi Krasner speaks about this at length in his amazing Nachalas Shimon on Yeshaya 1, numbers 31 and 41, and brings from the Noda Biyehuda a long discussion of how the Rambam could say what he says and his makor. Among other things, the idea is that וְעוֹשֶׂה מִצְוֹת וְטוֹרְפִין אוֹתָן בְּפָנָיו  doesn't mean that he doesn't get schar. It means that his schar goes to where his ikker roots/yenika are/is, so if he is a ben olam hazeh, all the schar goes to olam hazeh. If he does teshuva, and becomes a ben olam haba, then his schar goes to the olam haruchni, to olam haba.

Rosh Hashanah. A Guest Post by Rabbi Avraham Bukspan

I have the pleasure of corresponding with Rabbi Avraham Bukspan (Miami. Author of "Classics and Beyond/אבני קודש/Parsha Pearls", Feldheim Publishers).

This year, he sent me this amazing thought. I am not a fan of modern Gematrios. This outstanding piece is definitely an exception to the rule.

And Yaakov said, “How awesome is this place! This is none other than the home of G-d” (Bereishis 28:17).

After leaving his home and heading toward Charan, Yaakov lay down to sleep and had a prophetic dream. When he awoke, he realized that the place where he had slept was holy; it was the spot where the Beis HaMikdash was eventually built.

The Beis HaMikdash is a makom nora, an awesome place, since it contains the Presence of Hashem.

The sefer Imrei Noam, quoted by Rav Moshe Wolfson in Emunas Itecha (Parashas Ki Savo, p. 246, 249, 250), writes that the word ראש השנה has the gematria of 861, which is the same as בית המקדש.

This is also the gematria of only one pasuk in all of Tanach: (Tehilim 119:91), which can be translated: “To Your judgment they stand today, for we are all Your servants.” What better way to describe the yom hadin!

Rav Wolfson goes on to explain that during the ten days from Rosh Hashanah until Yom Kippur, the ten levels of  kedushah that are generally found in the Beis HaMikdash begin spreading out and enveloping the world, and get stronger every day. On the tenth day, Yom Kippur, we are on the level of Kodesh HaKodashim.

This explains why there is no mitzvah of aliyah le’regel on the two holiest days of the year: Rosh Hashanah and Yom Kippur. We do not have to go to Him; He has come to us!
This is also why we bow so many times on Rosh Hashanah and Yom Kippur – as was done in the Temple – because we are on that same level of kedushah; the sanctity of the Beis HaMikdash is here.
In addition, the chazzan begins the recitation of Shacharis from his seat, by saying “HaMelech,” and then walks to the Aron Kodesh and continues the prayer. During the rest of the year, the chazzan begins with Shochein Ad or Hamelech in front of the Holy Ark with the Torah - the closest semel of HKBH. On these days, however, we don’t have to go anywhere to be before Hashem; He is  where we are.
With this we can understand the meaning of the term Yamim Noraim, Days of Awe, in which the Shechinah of Hashem is present, just as in the Beis HaMikdash. When Yaakov awoke after his vision in the spot where the Beis HaMikdash would eventually be built, he said, “Mah nora hamakom hazeh – How awesome is this place.”
The Beis HaMikdash is the makom nora; the days from Rosh Hashanah to Yom Kippur are the Yamim Noraim. These are the days in which the Shechinah, the Presence of Hashem, is found among us, just as it was in the Beis HaMikdash; we just have to tap into It.
This idea dovetails with society’s term for Yom Kippur: the Day of Atonement. According to Oxford English Dictionary, the origin of the word atonement is at-one-ment. Although this is not the translation of the word kippur, which means to cleanse, the sentiment is clear.
Sin creates distance and a rift in a relationship. During these days of atonement, we are given the opportunity to reestablish the bond with Hashem – to reunite with Him. He wants us to use this time to take stock of ourselves, to look at our credits and deficits, and to see where we have to make changes for the sake of the relationship.
So we can truly be at one with Him, just as in the days of the Beis HaMikdash.

Here is my brief review:

It is well known, from, for example, Reb Tzadok, that the way a word is used in its first appearance in the Torah reveals a deep truth about its essential meaning.
Reb Tzadok, Yisrael Kedoshim 7:1

Also, Maamarei Rosh Chodesh Tamuz:

Also Bnei Yisoschor,

The period from Rosh HaShanah to Yom Kippur is called the Yamim Noraim. What is the first time the word נורא appears in the Torah? When Yakov realized that he was at the Shaar HaShamayim, at the Har HaBayis, at the place of the Beis HaMikdash.
Breishis 28:16-17

We see that Nora, in its truest sense, refers to a place where the spiritual world intersects with the physical, where the Ribono shel Olam makes HImself accessable to Man, the Beis HaMikdash, the Shaar HaShamayim.

It is, then perfectly appropriate to call these days the ימים נוראים, because ראש השנה is the same Gematria as בית המקדש.  They are 861.

And it appears that only one passuk in Tanach shares that Gematria, and that is
(Tehilim 119:91), a perfect description of Rosh HaShanah.

(There is another partial passuk, a phrase, in Tanach that shares this Gematria, though. That is Shemos 3:5, אדמת קדש הוא. That was Har Sinai, not the Beis HaMikdash. But it was, at that moment, Admas Kodesh.)

In fact, the Gemara tells us that the Tekias Shofar is akin to standing in the Kodesh Kodashim. Rosh HaShanah 26a:

Rabbi Bukspan uses this idea to explain why the Shaliach Tzibur begins HaMelech from his seat - because unlike other days, when we need to go the Mikdash to be in Hashem's presence, on these days, Hashem comes to us, wherever we are. Wherever we are, we are at the Beis HaMikdash, at the Shaar HaShamayim.

Excellent!

Rosh Hashanna 5773 and the Maharil

May Hashem grant you a year of great joy and success in Ruchnius and Gashmius

and a quick dvar halacha:
The Maharil says that one should not begin Yomtov earlier than necessary on the first night of Rosh Hashanna, and should, therefore, only make kiddush after Tzeis.  Because Rosh Hashanna is a day of judgment, it is inappropriate- even counter productive- to offer one's self for judgment before being summoned.  It expresses audacity and overconfidence, or indifference.  In any case, it is unwise to begin Rosh Hashanna before necessary.  He specifies Kiddush, suggesting that kiddush is a more serious matter than davening, because kiddush is deoraysa.

Reb Moshe, in an early teshuva (OC I 170, page 292), written in Lyuban, paskens that if, on the first night of Rosh Hashanna, one davenned the correct shmoneh esrei for Rosh Hashanna, but said האל הקדוש instead of המלך הקדוש, he does not have to repeat shmoneh esrei.

This was first proposed by a Yesh Omrim in the Talmidei Rabbeinu Yona in Brachos, but rejected.  It next appears in the Chayei Adam, who brings this from the gaon Rabbi Avraham Abbale Pasveller (b. Pasval, 1764, d. Vilna, 1836, for a time contemporary with the Vilner Gaon, who lived from 1720 to 1797,) head of the Beis Din of Vilna.  The Mishna Berura rejects this opinion, and even the Chayei Adam calls it "a big chiddush."

Reb Moshe is surprised that the Gaon Reb Abbeli didn't mention the Talmidei Rabbeinu Yona's earlier rejection of this shitta.  So Reb Moshe says that the Talmidei R"Y are talking about someone who says the entire weekday Shmoneh Esrei.  Reb Abbeli is talking about someone who davenned the correct Rosh Hashanna shmoneh esrei and the only error was saying Keil instead of Melech.  Although there is issur melacha at night, and all the laws of yomtov apply, the judgment of Rosh Hashanna does not begin until morning.  The concept that saying המלך הקדוש is essential, and that without it you haven't properly davenned shmone esrei, only pertains when Hashem is exercising Malchus through judgment, and judgment does not begin until morning.  (He proves this from the Gemara that says that the Beis Din shel Maalah seats itself only when Beis Din shel Mattah is seated.)

According to this, then, the rule of the Maharil should not be create a problem with davening maariv early even if he is mekabeil Yomtov explicity.  One has nothing to do with the other.  You can be mekabeil yomtov as much as you want, but the din does not begin until the next morning.

As I said before, the Maharil was only talking about making kiddush early, not about davening early, and I'm assuming that this is bcause a person can daven before he is mekabeil yomtov, while Kiddush is a real kabbalas yomtov.  (Only according to the Rambam can a person make kiddush without being mekabeil Yomtov, and I believe that's a daas yachid.)  But the minhag is to avoid davening maariv early, too, out of concern for the Maharil and in general in order to say Krias Shma in the right time.

So at the minyan I'm making, we're davening maariv after ג' רבעי מיל out of respect for the Maharil and so Krias Shma shouldn't be too early, but we're not waiting an hour, on the basis of Reb Moshe's psak.

Here's a compilation of shittos regarding the Maharil, taken from ישראל וזמנים by ישראל דוד הארפענעס.  I don't know who he is and I take no responsibility for the content, but it looks good.

For Rosh Hashanna

Yesterday, a friend was in the local Hebrew bookstore, and a woman with very little Jewish background was talking to the clerk about the Yamim Noraim.  She said that she knew that Rosh Hashanna is the day of judgment, and Yom Kippur the day of foregiveness, but she said she always wondered why judgment would come before forgiveness.

The question is very good, and was, famously, discussed by Reb Yisrael Salanter.  Coincidentally, yesterday I head what in Telz they call a shiur daas on that topic.  Rabbi Levin said in the name of his wife's grandfather, Reb Chatzkel Levenstein of Ponevezh, an answer in the name of Reb Yitzchak Blahzer.  He said that only after Klal Yisrael is mekabel ol malchus shamayim is it possible to have a day of kapara.  Only after we realize that Hashem is our king, and that by not doing what Hashem wants we are mored bemalchus, then Hashem is willing to be mochel.

I recently saw someone an interesting and relevant mashal that clarifies his idea.  A king sends two servants to do some menial job.  One is very skilled at this work, and does it perfectly, but feels that is an unfair imposition, and so he does it with resentment and a scowl.  The other is not particularly good at this kind of work, but he does it with pride, happy to be able to serve his king.  What is the difference between the two?  Who is the better eved?  The difference is not just who is the better eved.  The first one is not an eved at all, he is a moreid bemalchus.  The second one is a loyal eved.

So it's not just a matter of doing aveiros.  When we do mitzvos, if we do them besimcha, then our actions proclaim that we are avdei Hashem.  If we do the mitzvos, but we do them as if they are a burden, then we are moreid bemalchus.

Reb Chatzkel added that there is a difference between a melech and a talmid chacham.   A talmid chacham has the right to forgo his kavod; machal ahl kvodo, kvodo machul.  A king has no such right; melech shemachal ahl kvodo, ein kvodo machul.  But why can't a king be mochel?  Because his malchus is not his, it is a stewardship granted by the Ribono shel Olam, and the king can't be mochel on what is not his.  The Ribono shel Olam, on the other hand, is a King whose malchus belongs to Him, and so He can be mochel on His kavod.  But the Ribono shel Olam is only willing to be mochel on his kavod for his avadim.  First, we have to be Avdei Hashem.  Only once Klal Yisrael firmly and proudly declares, and demonstrates through their behavior, that Hashem is their king, only then is Hashem willing to be mochel ahl kvodo.  After Rosh Hashanna, when Klal Yisrael is mamlich the Ribono shel Olam, only then Hashem chooses to be mochel ahl kvodo.  Only then is the mechilla of Yom Kippur possible.

In fact, we can say that asking for kapara on Rosh Hashanna would be contrary to the idea of Malchus.  Why should a melech be mochel?  A melech is makpid that his servants do his will with pride and alacrity.  Bringing up our failings and asking that they be dismissed diminishes the whole concept of Malchus.

This enables us to discuss another question.  The Gemara in Bava Kamma 50a says "One who says Hashem is a "Vatran," his life will be mevutar.  In other words, one who says that Hashem dismisses sin, may his life be dismissed.  The point of the Gemara is that Hashems's justice is immutable and inexorable.  So how canYom Kippur bring forgiveness?  Isn't clemency a waiver?  The answer is that just as the Rama MiPano said that the din of Rove is not vitur
If so, we can say that the din of Yom Kippur, even if it is mechapeir without teshuva, is that once Klal Yisrael as a whole is Mamlich the Ribono shel Olam, Hashem is mochel to His avadim.  This is a din, a result of what we do on Rosh Hashanna, and not vitur.

And what is the best way to be makabel ol malchus shamayim?  Chazal say that it is through Malchiyos, Zichronos, and Shofros.  But I like to say over the Tanchuma in Parshas Tzav, which I think is also key to kabalas ol malchus shamayim:

Perhaps we can apply the Tanchuma to the Gemara in Brachos as well:

What's the shaichus of Hashem being ma'avir kol tuvo, and the kapara?  Maybe the pshat is that w
hen a person realizes Chasdei Hashem and the opportunities Hashem has given him as a gift, then Hashem will be meracheim on him, even if he doesn't deserve it.  Hakaras Hatov is the key to Yiras Shamayim and to Kapara.

Once again, we see the idea of Gilu bir'ada, that Rosh Hashanna's avoda is to rejoice and to fear, to rejoice that Hashem allows us to serve Him as His avadim, and to fear His judgment.  A person who is properly mekabel ol malchus shamayim is in a position that enables the kapara of Yom Kippur.

Which brings us back to the Ibn Gabirol we once discussed.
